Customized Product Orders

1.1 Definition of Customized Products

Customized products include, but are not limited to, any order where the following modifications are requested by the customer:

  • Changes in carved furniture design.
  • Alterations in furniture measurements and sizes.
  • Modifications in polish/paint or fabric design.
  • Any additional alteration or modification to the product that requires extra work beyond the original design.
  • Additions requiring additional work for added products.

1.2 Approval and Timeline for Customized Orders

The standard delivery timeline for customized products will commence only after all customization-related approvals from the customer are finalized and documented. The initial delivery timeline provided for standard (non-customized) products will be superseded by the timeline starting from the date of the final approval of all customizations. From this date, Healsway's standard shipping and delivery timelines will apply.

1.3 Non-Cancellation and Refund Policy

Once the manufacturing process of a customized product begins, the order cannot be canceled. No refunds will be processed for canceled customized products, as per UK consumer law exemptions for personalized goods under the Consumer Contracts Regulations 2013. However, Healsway may consider product exchanges at a later stage, subject to mutual agreement between the customer and Healsway.

1.4 Sale of Cancelled Customized Products

If a customer cancels a customized order after manufacturing starts, they may authorize Healsway to advertise and sell the product. Once sold, the sale amount, which must be equal to or greater than the amount paid by the customer, will be credited to the customer’s account. Healsway will deduct handling and bank charges from the total, with the remainder credited to the customer.

 

Cross-Border Shipping and Customs Regulations

2.1 Customs Clearance Delays

Healsway Systems Solutions Limited is not responsible for any delays caused by customs clearance processes in any country, including the UK and international destinations. The duration required for customs clearance is beyond Healsway's control, as these procedures are mandatory and governed by the respective countries' regulations. Consequently, any delays arising from customs processes are not covered under Healsway’s delivery timeline as provided on our website.

2.2 Cross-Border Shipping Terms

All products are manufactured in India and shipped to the United Kingdom or other international destinations. The shipping timeframes provided are estimates based on normal processing times. However, due to the potential for delays in customs clearance or other cross-border regulatory checks, Healsway does not guarantee exact delivery dates. Customers will be kept informed of any delays due to these factors.

 

Shipping Delays Due to External Factors

3.1 Force Majeure (Acts of God) Clause

Healsway Systems Solutions Limited shall not be liable for any shipping delays caused by circumstances beyond its control, including but not limited to:

  • Natural disasters (e.g., earthquakes, floods).
  • War, terrorism, or political instability.
  • Ocean alerts or maritime disruptions.
  • Labor strikes, port congestion, or other disruptions to shipping channels.

3.2 Exclusion from Delivery Timeline

Delays resulting from the aforementioned circumstances will not be counted within the delivery timeline provided by Healsway. Customers will be informed of any such delays, and Healsway will work diligently to ensure delivery at the earliest possible time. However, these delays are not grounds for cancellation or refund under the standard shipping terms.

 

Consumer Protection and Legal Compliance

4.1 Compliance with UK Consumer Protection Laws

Healsway Systems Solutions Limited adheres to all applicable consumer protection laws and regulations within the United Kingdom, including but not limited to the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, and the Sale of Goods Act 1979. These terms and conditions are designed to provide clear guidelines while protecting both the customer's rights and Healsway’s business interests.

4.2 Resolution of Disputes

Any disputes arising from these terms and conditions or from the customer's use of our services shall be resolved through negotiation, mediation, or arbitration, as mutually agreed upon by the customer and Healsway. If no mutual agreement is reached, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

4.3 Updates to Terms and Conditions

Healsway reserves the right to update or modify these shipping terms and conditions at any time without prior notice. The most current version will be available on our website, and it is the customer’s responsibility to review these terms periodically.

4.4 Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. By placing an order with Healsway, customers acknowledge and accept these terms as part of their purchase agreement.

4.5 Limitation of Liability

Healsway's liability for any delays or issues related to customized orders, cross-border shipping, customs clearance, or force majeure events is limited as outlined in these terms and conditions. Healsway will not be liable for any indirect or consequential losses, including loss of profit, except as required by law.
